BLCONS GROUP: 20.07.2023 Business Degustation “Customs Disputes: Development of Judicial Practice on the Inclusion of Royalties in the Customs Value”
On July 20, the audit and consulting company BLCONS GROUP holds a closed meeting, during which we will consider the specifics of customs disputes related to additional payments in the form of license payments.
Starting from 2022, the approach of the courts in cases of challenging customs decisions has changed. Now the courts support the position of the customs authorities on the legality of including license fees in the CU with reference to subparagraphs 3 and 7 of paragraph 1 of Article 40 of the EAEU Customs Code without distinguishing the legal grounds and without taking into account the actual circumstances of each declarant. At the meeting, we will discuss the arguments for and against this approach.

- Review of current court cases on additional customs payments in the amount of royalties for the use of know-how;
- Arguments “for” and “against” the approach applied by the customs authority: economic vs. legal;
- Challenging decisions on the adjustment of the customs value of goods: reduction of state duty when applying to the court.
